<p>This a fraud report on the following company:-</p>
<p>K Enterprises LtdMorcellement Raffray,<br />
St Pierre Mauritius<br />

Fax:230 433 4332</p>
<p>Above company purchased fabric from Beta Textiles Co.,Ltd in China.<br />
It was agreed in advance that they would pay 30% advance before shipment.</p>
<p>But they did not pay advance saying shipment was very urgent. Beta Textiles Co.,Limited shipped the cargo, the cargo was then released by paying a portion of the payment.<br />
Against the release of cargo, K Enterprises Ltd signed an agreement that they would pay the money no later than Dec 29, 2009.</p>
<p>The balance money is never paid. Whenver they were asked to pay the money, they always find reasons and excuses.</p>
<p>The fraud company is a company producing underwear. All buyers and suppliers are warned not to deal with such company.</p>
<p>The fraud report will not be deleted until and unless the amount of 4559.34 USD is paid in full.</p>
<p>Miss Daya Nadar ( A mauritius citizen) is a wintess of the fraud.</p>

<p>Agreement on the Release of Cargo on Credit<br />
This agreement is entered as of Nov 11th, 2009 by and between:-<br />
Daya Nadar<br />
K Enterprises<br />
Address: Morcellement Raffray St Pierre Mauritius<br />
Tel : 230 433 4447 / Fax :230 433 4332 (“K Enterprises”); and</p>
<p>John Zhang<br />
Beta Textiles Co., Limited (“BTEX”).</p>
<p>Whereas:-<br />
1. The cargo under B/L no.FJWFW9090036 has arrived and ready for clearance;<br />
2. The Buyer is encountering financial difficulties and is unable to pay as agreed.</p>
<p>Now it is mutually agreed that:-<br />
1. BTEX shall release cargo upon receipt of 2500 USD payment;<br />
2. K Enterprises shall pay the balance of USD 4859.34 (UNITED STATES DOLLARS FOUR THOUSAND EIGHT HUNDRED FIFTY NINE AND THIRTY FOUR CENTS ONLY IN WORDS) no later than Dec 10th, 2009 unconditionally;<br />
3. Arbitration Clause<br />
Any dispute, controversy or claim arising out of or relating to this Agreement , or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the UNCITRAL Arbitration Rules as at present in force and as may be amended by the rest of this clause. The appointing authority shall be Hong Kong International Arbitration Centre. The place of arbitration shall be in Hong Kong at Hong Kong International Arbitration Centre (HKIAC). There shall be only one arbitrator. Any such arbitration shall be administered by HKIAC in accordance with HKIAC Procedures for Arbitration in force at the date of this Agreement including such additions to the UNCITRAL Arbitration Rules as are therein contained.<br />
3. In case K Enterprises is unable to honor the payment on time, all arbitration fees, costs, expenses, charges, overheads shall be borne by K Enterprises.<br />
4. The B/L under this agreement is an integrate part of this Agreement.</p>
